General terms and conditions of business and delivery
1. Scope of application
1.1. These General Terms and Conditions of Business and Delivery apply to the online purchase of goods from SPAR EDER Handels GmbH - www.spar-zillertal.at. They shall be regarded as acknowledged and agreed as soon as you place your order. Online purchases are tendered and processed exclusively in accordance with these conditions.
2. Your contractual partner
2.1. Your contractual partner for the online purchase of goods from SPAR MARKT EDER online supermarket is SPAR EDER HANDELS GMBH, Hauptstraße 473, A-6290 Mayrhofen
3. Product range and prices
3.1. The product range in SPAR MARKET EDER online supermarket is subject to change.
3.2. The prices quoted include statutory VAT, associated service costs are not included in the price of the goods.
3.3. Prices apply exclusively for normal household quantities and are limited to a maximum order quantity per product. All promotions and special offers are valid in the online shop, even in the absence of appropriate labelling.
4. Orders and conclusion of contract
4.1. Placing your order, based on an offer made by SPAR MARKT EDER, shall be deemed as intention to enter into a purchase contract. The purchase contract shall come into effect upon acceptance of the order by SPAR MARKT EDER. Dispatch of the ordered goods by SPAR MARKET EDER constitutes acceptance of the order.
4.2. Orders are placed using an online form, during which you will be provided with all necessary information. Before you confirm your order and send it to SPAR MARKT EDER, you have the opportunity to verify the accuracy of the submitted information and correct any mistakes. Once your order is complete, a message to this effect will appear on your screen.
4.3. Your order can only be dispatched when all mandatory fields have been filled in, the total price of the ordered goods exceeds the minimum order amount, in the event of requested delivery, the delivery address is located within the delivery area, you acknowledge that you are over the age of 18 and accept these General Terms and Conditions of Business.
4.4. SPAR MARKT EDER will confirm receipt of your order by sending an email to your registered email address. This email only confirms receipt of your order, but does not constitute acceptance of your order. An order shall only be deemed to be finally accepted and irrevocable, when SPAR MARKT EDER dispatches the goods to the agreed collection or delivery point.
4.5. Should ordered merchandise not be available, your order will consist of all dispatchable goods at the time of order processing. In this case, the purchase price will be reduced accordingly.
4.6. For goods whose order quantity and price are based upon weight (e.g. sausage meat, cheese, fruit, vegetables), deviations from the order weight are sometimes inevitable during processing of the order. You expressly agree to accept variances of up to 30% (based on order weight) and the corresponding variance between the order value and invoice value.
4.7. Please note that any alcohol you may have ordered may only be handed over to persons over the age of 16 years. Distilled beverages and spirits (including alcopops) may only be delivered to persons over the age of 18 years. Should there be any doubt, photo ID may be required on delivery or collection of your order.
5. Payment
5.1.Payment of the purchase price for your ordered goods is due upon acceptance of your order.
5.2. Payment shall be made in accordance with the selected payment method in your order.
6. Collection and delivery
6.1. You can choose between collecting your goods in SPAR MARKT EDER in Mayrhofen, or to have them delivered to the location of your choice within the delivery area.
6.2. For collections, you must determine the day of collection in the allocated field on the order form. Should you not collect your order on the given day, the risk of accidental loss or deterioration of the goods will pass to you. Collection at a later date is not possible.
6.3. For the delivery of ordered goods, SPAR MARKT EDER charges a delivery fee which is considered to be part of the purchase price. See delivery service!
6.4. Deliveries will be made to the address specified in your order.
6.5. You can determine the time slot for deliveries in the allocated field on the order form. If delivery during this time slot is not possible for reasons for which you are responsible, the risk of accidental loss or deterioration of the goods will pass to you. SPAR MARKT EDER will make every effort to comply with your chosen delivery time slot. In exceptional cases, delays of up to 2 hours later than your selected time slot may occur. In this case, delivery shall also be deemed as timely.
6.6. SPAR MARKT EDER is not obliged to make a second attempt at delivering ordered goods. Your goods package will be made available for your collection in SPAR MARKT EDER for a period of 1 day. Notification to this effect will be placed at your front door or post box. If a Saturday delivery is unsuccessful for reasons for which you are responsible, there is no possibility for later collection.
7. Contract withdrawal
7.1. Should you exercise your statutory right as a consumer, SPAR MARKET EDER must reimburse the amount equal to your payment, while you return the goods affected by the contract withdrawal to SPAR MARKET EDER. The costs of the return shall be borne by you.
7.2. Should the returned goods be spoiled, damaged or incomplete and therefore no longer suitable for resale, SPAR MARKET EDER reserves the right to levy an appropriate charge for their use, including compensation for the devaluation of the product.
8. Liability
8.1. SPAR MARKT EDER is only liable for damages caused by wilful or grossly negligent behaviour. Excepted from this is liability for personal injury, for which SPAR MARKT EDER shall only be liable for damages due to slight negligence.
9. Online Dispute Settlement
Online dispute settlement in accordance with article 14, section 1 of ODR-VO: The European Commission provides a platform for online dispute settlement (OS) under http://ec.europa.eu/consumers/odr/.
